Prosecutors have asked a judge for a pre-trial detention hearing in the human smuggling case against Kilmar Abrego Garcia, after he was brought back to the U.S. Friday.

Kilmar Abrego Garcia, a Salvadoran native who lived in Maryland and was mistakenly deported, is now claiming he was denied due process in recent documents.

A Tennessee judge is scheduled to hear arguments about whether Kilmar Abrego Garcia can be released from jail prior to his federal trial.
